Subject: DENIED REFUGEE APPLICANT
  Hi, my live-in partner for less than 6 months was denied his application of refugee immigrant visa last year. he was found untrustworthy and was escorted by embassy officials to the airport on the date he left canada to go back to his country. I´ve just given birth to our child last march and was wondering if he could come back to canada to visit us. my other concerns are: what is the implication if you are found guilty by the consul in your interview for immigrant status? and why would a denied applicant need to be escorted by embassy officials to tahe airport? and how long can a failed applicant apply for another tourist/imigrant visa?

I believe because they give you a number of days to leave voluntarily. If you don´t, the government pays for it and they escort you to leave since you no longer have a right to be in the country if his refugee status was turned down. Further more, if he was escorted, if you marry him, you may have to get permission from the government and pay a fine in order for him to get back in, if they grant him PR status based on spousal sponsorship.

so they won´t pay too much attention on the reasons of his failed refugee application? do you have any idea on how long will it take for me to get permission and how much would it cost? do you think we will qualify in the spousal sponsorship, eventhough we only lived together for only 4 months? and we don´t have the same address/contact information while he´s here?

where in canada are you from?

as far as i know, if you want to sponsor him as spouse, you have to provide marriage certificate. and he has to provide you cenomar (certificate of no marriage).

and under common law sponsorship, u have to have at least a year lived together. with tons of proof. bank account, rentals, pictures,.. etc.

and u mentioned he was escorted to the airport, like deported? his application again, in my opinion, will be very rough for u guys. and his previous application which was denied will be highlighted, believe me.

Essentially the reason why he failed as a refugee should have nothing to do with the sponsorship, but since we all know that is not likely the case, I would assume they would consider it. That being said, many refugees are declared ineligible because the government says they are not credible, and end up back on sponsorship. My concern would be the fact that he was deported, that he didn´t leave on his own free will when he was asked to.
