Subject: returning to canada after deportation
  I have a friend who applied as a refugee in canada but her application was denied, she was deported and went to the States to applied for asylum, after a long process (4 years) her application was denied and she just got a letter saying that she has to leave the country in July 2008.

Does anyone know if she can come back to canada and apply again?

Could somebody please help me to get info? what would be the procedure?

The only way you can return to Canada legally is to seek authorization to return based on a concept.

Now married to a Canadian, that you have a offer of employment and you intend to come for only a temporary period of time etc. and you need to explain why you should be given authorization to return.

When the fat lady sings, it´s over, game finished, you lost. Forget claiming refugee status again. Why you lost your claim in two separate countries or how long it took is not important.

Become a member of the majority and get in line.

Google the De Sousa Story they made a refugee claim based on the well founded fear of persecution due to lack of work in Portugal a European Union country. Now they did not know that was the reason given for the refugee claim until they signed the papers. They actually thought they were applying for something else but when they found out it made no logical sense based on their personal circumstances to abandon the refugee claim.

They returned with authorization and the Father got an employer specific work permit the Mother got an open work permit and the kids that were school age got student permits.

Hi
I am a candaian citizen.My husband is is refused refugee claimant and he left canda under departure order (removal cause A36).and in daparture certificate for answer to question Criminality -it say no.

But according to my search for this A36 is for serious criminality.but my husband has no criminal record.

I am worried what will happen now.

I am married for last 7 years and i have two children of age 6 and 3 and i am hardly surviving at this point.

Can you please suggest me some possible outcomes and what should i do.

and how long it takes to get ARC.

I was departed from Canada in 1974 after overstaying my student visa permit. I am now a US citizen and have visited Canada numerous times at the border crossing and at Pearson.
But in June 2010 they stopped me at the border and informed me to get authorization to return to Canada. What exactly do i need to do...no one answers at the Canadian Embassy?

Charn, filed an application to sponsor your husband, and he may need an authorization to return.

I went to visit Canada from England when I was stop and told I cannot enter Canada because there us a warrant for my arrest from the US , I explained that I was deported as my wife withdrew my sponsorship, to cut the story short I was taken to a detention center where some of my documents was misplace, they realized the mistake and still kept me till I told them I want to go home as I have a return ticket, I have been told I can come back to Canada anytime but the issue is my documents in which they cannot locate all of these documents was taken from me at the airport Pearson,HAs anyone been in this same situation and what did you do to get your documents back?

My fiance was deported from Canada 7yrs.ago. We got back together a yr. and half ago. He currently resides in St. Lucia. He was sent home for having criminal issues. Left with no problems. As of right now, we are waiting for RCMP to do their report for Pardons Canada. I am assuming that is all the permission he needs to gain back entry into Canada. He doesn´t need a visa. To answer any questions, to gain entry,,,be sure to get Pardoned first. It is illegal to try to come here with a criminal record and you will get stopped and held at Customs an Immigration. Having said that, there is a time frame you have to wait before appying for that. You need to have fingerprints and background check from home country to submit. My question, after Pardon is complete, is that all we have to do? The Pardon squashes the criminal background and the emails I have received from them state,"for safe work and travel purposes". BUT, he was/is a deportee. Can anyone help me fingure this out? Upon arrival to Canada, we do plan on getting married. Waited a long time for this.

he may still have a problem with entry because he may not be able to convince border officials that he is only visiting. How about going to St Lucia, getting married and applying to sponsor him the moment he has his pardon.

He has his family here, mom, dad etc...,,The problem with getting married there in St. Lucia is, what if I get denied in sponsoring him and he can´t come? Then I would be married to someone I can´t be with. The point of getting married here is so that our families can be present. The Pardon process is almost up, after that, I have no idea what to do. I have looked up applying to re-enter Canada, but all I can find is temp. visa permits and USA stuff. He doesn´t require a visa to be here. I am really confused about all of it. The sites are not clear at least to me. I think I may need to call Immigration Canada to find out about Deportees, Pardons and returning. As far as buying him the one way ticket here, if I purchased a return ticket for 6 months, but he wanted to go back early, the money is lost. But, if he decided to stay longer, then we have to apply for an extended stay. ANOTHER long process. As for the Pardon, once he arrives at the airport, will customs and Immig. see he was deported or is it whipped clean and they see nothing?

there is ALWAYS a risk when marrying someone from another country that they will not be allowed into Canada. ALWAYS. If you want a guarantee that you can be together, you should be planning to move to St. Lucia. If you want a chance to appeal... you file an outland rather than inland application.

Many applicants end up with a civil wedding followed by a family wedding at a later date. Inconvenient but that is the way it goes.

Until the pardon is complete, the entire subject is moot.
