Question about ex-husband.

Subject: Question about ex-husband.
  My ex and I were married for 7 years and divorced August 2007. We have realized we made a mistake and have gotten back together. Of course, he is still in the US and is a US citizen and I am in Canada and am a Canadian citizen. We want to make our home here in Canada. We do plan on remarrying eventually but I am wondering if he would qualify for common-law if we were married and lived together for 8 years. Do the "continuous 12 months" of living together mean the 12 months previous to filing? Any help is greatly appreciated. Thank you.

I believe the realtionship needs to be currently common law so I would suspect the 12 months prior to application are the ones being considered.

Okay people make mistakes but the regulations and the required documents will obviously cause you more difficulty.

Remember most spousal/common law type applications are viewed as if the relationship is bogus.

Jennifer you will have to submit your divorce certificate or final decree. That will have a date on it. Depending on where you got your divorce there are rules on how long before the divorce was issued that states you must live separate and apart.

IF it was truly a mistake then marry him again. Tell how silly you were and he can tell how silly he was in detail.

Common Law will not work.
