Subject: Roy & Sharon... Certificate of No Marriage
  Hi Roy and Sharon ,

I am in the process of sponsoring my Filipino wife to Canada. She´s currently living in Japan and have been for the last 20 yrs. She previously been married to a Japanese national and subsequently divorced him. Her divorce was recorded on her husband´s koseki tohon and was reported to the Philippine Embassy in Tokyo.

As we all know, divorce is not recognized in the Philippines. My concern is with my wife´s cenomar (certificate of no marriage), it says that she´s still married to her ex husband; eventhough, they legally obtained a divorce in Japan.

The Canadian Immigration in Manila requested her cenomar, so I am worried that her married status on her cenomar would affect her PR application. Do you know whether Canadian Immigration would grant more weight to her divorce papers rather than her cenomar?

Can you please enlighten us to this matter? I am sure there are similar cases like ours, so anyone else who can also help us?

Everything is based on two sets of laws regarding marriage and divorce when it comes to sponsorship.

Was the original marriage approved and legal by the country that it was performed in?

Was the original divorce approved and legal by the country it was performed in.

The Canadian Divorce Act states the divorce must take place in the country where the two normally re4side.

The request for this "cenomar" is nothing more then normal procedure from someone that has not even looked at your file.

You have got to be fine, relax.

Need a few clarifications. V would be moving to canada shortly, i want to know, how is the job market for Paramedicals. And wat is the cost of living for an average family of 4 (2 Adults and 2 Kids).

Hi Roy.
Thanx for the reassurance.
However,I think someone at Canadian Immigration in Manila did looked at her file because they not only requested her "cenomar" and "NBI clearance" but also asked her to re do the personal history question of her part of the application because she filled it out incorrectly.
BTW, they also requested that she send in her original passport; so I´m taking that as a good sign.

Getting back to my original query, my wife married and divorced her ex husband where they resided in Japan. I sure hope that Canadian Immigration would overlook her married status in her "cenomar" and recognize her legal divorce from Japan.

Good day, I would like to inquire regarding the Certificate of No Marriage Requirement ( CENOMAR ). I was previously married in a Civil Ceremony when I was 21 years old to an Filipino American Citizen ( a relative of my cousin ) for the purpose of Obtaining a Fiance Visa in order to go to the U.S. ( I am a registered Nurse ). There was no consummation of the marriage. I also was never able to go the U.S. because soon after this marriage there was a disagreement between my family and my cousin´s family, and soon after I went to work in Saudi Arabia. However, this marriage was never annulled. I consequently got married to my present husband last January 2005 in a civil ceremony and in April 2005 in a church wedding ceremony. We had our child in the same year on September 2005. Currently we are processing our papers in order to migrate to Canada. my query is this, What would happen to our immigration status if ever it will appear that I was previously married before I was married to my husband? Right now I do not have documents regarding annulment of my first marriage. I really hope you could reply me on this matter as I am having sleepless nights right now while waiting for our Certificate of No Marriage from the National Statistics Office. Thanks.
