Subject: Canadian Immigration for Separated Couple
 
Hello,

I am planning to apply for Canadian Immigration on skilled worked category. Currently I am married but separated my question is if I am showing my current marital status as "Separated", do I have to give details of my spouse on details of family members section. I am not planning to show her as dependant.

Yes you have to show because tomorrow you two could be back together and she will have to do a medical.

In Canada there is no legal seperation as there is in certain countries.

On Application For Permanent Residence In Canada in section 9 "Your Current Marital Status" there is an option available as "Legally Separated".

If I have to show her on my application do I need send a copy of her passport and passport size pictures as well? I have one passport size picture only (the requirement is 4) does that work...

I am not planning to show her as dependant though..Please help

This all depends on several factors.

Country of citizenship/visa post etc.

Roxtox I know what the forms says and I know what the act and regulations say.

A dependent is a dependent so get a divorce!

The same is the case of mine.I got separated 4 years after applying.Now they r reviewing my case and asked me to submit updated documentation.I m not legally separated and divorce is impending.I m showing her as family member and attaching court papers.It may delay the processing but I m on the side of truth ,come what may .dont hide anything from them.They may issue visa to u and she as a dependent /family member still can claim visa with in one year of ur arrival in canada if she comes to know of ur immigration.so if u get visa keep it a secret.God is great.

Hi Roy:

Got your email from your website. I would like to ask a question.

I have applied for Canadian immigration under federal skill category and received a letter to submit an updated documents. Initial submitted application, I had claimed as married in the application. My situation is that I and my wife are living separately for the last three years. I live and work in dubai due to work reasons and she lives in India. No contact(email or phone or any form) is there between us. Our marriage has not been registered yet. We do not have any joint accounts or nor any property in both our names. However, I have property in my name.

1. What documentary proof is required if I claim as legally separated?

2. Since marriage registration in India requires both presence, it is unlikely we can get marriage certificate. However, I do have a notarized affidavit claiming that we are married ? Will this document acceptable in lieu of marriage certificate?

3. What is Annulled marriage? How it will help above situation? What documents are required for this?

I am in a situation where i want to apply for immigration for my self only as my husband is not cooperating in providing documents and he is not interested.

Will it affect my application negatively? what can i do to make application successful?

Hello,
I am legally separated since 2008 and have documents to support that.
So i am planning to get a tourist visa for a girlfriend and have a 2 year old child with her (its my child) to come along. is this possible? what are the chances of her getting a tourist visa or even an immigrant in ontario

hi , iam applying for Canada PR . me and my husband have filed for divorce. i am from india . we have signed the documents in the court for divorce . i also have a court order to prove that . however, as per law , court has given mandatory 6 months to re consider our decision and the final sign will be after 6 months , post that we will be issued a decree of divorce. while fillinf up the form for canada´s PR , iam confused as to hat to mention in my marital status - separated m legally separated , divorced , single ? pls give a lawfully correct advice. thanks a lot
