Subject: sponsership breakdown
  One of my friend brokedown 10 years sponsor ship agreement few years ago due to financial problems. If he cant afford to support those people who he sponser will he get charged or ....?

He asked me to see if anyone has the same situaltion in the forum. I really want to help him but dont have any good immigration experience.

A couple of years back there was a news story about CIC coming after sponsors who signed undertakings for people that ended up on welfare etc. It was very clear that CIC takes those contracts seriously and in some cases it meant the sponsor being force to sell their house to pay the bill.

If CIC does not enforce those undertakings there is no motivation for a sponsor to be cautious about who they bring to Canada under their name. Complaining after the fact that they did not know, or did not think that person would turn out to be a jerk or did not imagine their own financial situation would be impacted really does not change the reality. A contract is a contract.

Will he be charge - no. But they will insist he re-pays the government should those he sponsored require formal assistance. if they don´t, his personal situation will not be affected.

I understand that but what other alternatives for him. He wants to re pay but financially he cant right now. Where he can go for help.

has he received a demand notice from the government?

if he does not have the funds he will be required to negotiate some form of repayment schedule with CIC (perhaps with the assistance of the nice people he sponsored) or he will need to negotiate the process through a trustee in bankrupcty.

not sure how hard CIC pushes but there are organizations out there that assist people in financial duress with negotiations.

Define what you mean by "a few years ago".

Spousal sponsorships used to be for 10 years duration and now they are three years.

Before they did not have the legislational power to come after a person but now they do. Normaly they catch people who have failed in their obligation and then want to sponsor some one a new.

The worse case I have ever seen is a man who sponsored his ex-wife and her 15 year old daughter. His relationship with his spouse soured but his step daughter was very strong.

He even paid his step-daughter tuition for college and gave her funds for books and residence. The step daughter went on welfare and when he tried to sponsor another he had the hardest time ascertaining how much money was owed to welfare.

Rev. Canada will not likely come after you but......they could. More likely CIC will refuse any future sponsorship applications.

As per him, When he was sign off the breakdown agreement the social worker advised him all other stuff that will affect in the future but didn´t really explain the re-paying issue. that he will never be able to sponsor or co sponser etc but the worker didn´t really tell him whether CIC will come after him for re-pay. He assured no one told him about re-pay when he was signing off his breakdown agreement.

If payments from a federal, provincial or municipal assistance program are made during the validity period of the undertaking to the person you are sponsoring or his or her family members, you

will be considered to be in default of your obligations,
may have to repay to the government concerned any benefits they received, and
will not be allowed to sponsor other members of the family class until you have reimbursed the amount of these payments to the government concerned.


´may´ have to repay is the words they are using, but for sure, all monies would have to be repaid before another sponsorship is attempted.

The news item I watched was some Indian families complaining that CIC wanted $50,000 from them for payments made on their behalf to look after their sponsored applicants. They thought it was unfair but CIC said that they signed the agreement!
