Subject: sponsor my husband in US
  Hi,
My fiancee got into USA in 2000 on a visitor´s visa, he overstayed his term and was going to be deported, he married an American citizen but his green card was denied because the marriage was considered not real.

Then he filed for political asylum and it is still in process.

They seperated in 2002 and we met in 2003. They filed for joint petition for divoice in 2007 and it wiill be finalized in May 2008.

We will get married in June 2008 and I will sponsor him to come to Canada right after our marriage.

Are we going to run into any problem because of his history in US? Do I need to hire a lawyer?

No you do not really need to hire a Lawyer or Authorized Representative as long you are willing to understand the chances of him being approved without an interview by CIC are close to NIL. Lawyer´s almost always have no hands on duty in these type of cases the process is left up to some junior staff member. Common sense must prevail.

He will highly, likely be interviewed and not in the States! Understand that he will have to go back home.

When he completes his forms MAKE SURE he tells the truth. They have ways of finding out especially from USINS. Since he is in the USA and was never admitted legally for one year his application will have to go through his countries Visa Post. See IRPR R11 (1)

So ask yourself this Question.

He has used the system before on several ocassions and thinks he is knowledgeable regarding Immigration issues. Is he using you?

CIC will see it that way! So go overboard in proving a bond between the two of you. You have an awful lot of work ahead of you if you want him to be allowed entry into Canada as your spouse.

If you do hire someone be sure that they van prove their track record in similar cases and will let you speak to their success stories.

You need all the luck you can muster.

Interesting question. I heard once it helps to get priority in processing. Lets see what Roy says.

In any way, he has to return back home.

So you have an egg and he has sperm that can swim, SO? Getting pregnant does not prove the fetus is his! It means your pregnant.

I´m all for tipping the scales in favour of any client. Continuing down the same path as he has travelled is so illogical. Trying to create a life just to expedite a process is soooooo WRONG!

HE LIED! Focus on that! Focus on Regulation 11 (1)

Yup he lied and has tried to abuse the USINS system, more then once. He even abused the USINS system with a spousal sponsorship application that you intend to submit for entry into Canada.

The issue is not where he is residing, not wheter or not he has legal status where he is but where Canadian Law (IRPR) Regulation 11 (1) says he has to SUBMIT his application. He can stay there but the odds of him getting a waiver of an interview is very low.

So lets say he is from Iraq he would probably be interviewed in Damascus. Port of Spain, Trinidad is the Visa Post for most Caribbean countries but sometimes if he was from Guyana lets say he would be interviewed there.

In theory if certain factors already exist then you could file your sponsorship application now. What ever you do understand the onus and it is a big onus based on your posting to prove the bond between the two of you.

The one thing you have to do is change your attitude from the path he has already taken. I do understand that being seperated SUCKS but take the better road.

I´m not sure if your asking this, but..... any Authorized Representative Belvidere that would check over someones spousal application forms would not be worth much.

After paying for education, then membership fees, Insurance, Continuing Professional Developement an Office etc. etc. to charge for doing a small percentage of the work necessary and still could be held responsible.

The answer is NO!!!!! Either we assist from the beginning or not at all.

Logical?
