Subject: Abandoned Wife
  My friend´s Pinoy husband was denied refugee immigrant visa last sept.2007 with a negative evaluation of "untrustworthy". he is now here in the Phil. but won´t live with my friend because he left a pregnant Pinay girl in Vancouver, who´s waiting for her permanent landed imigrant card which was due mid this year. They´re both married, both families are here in the Philippines, but they opted to live together last June-Oct.2007 and leave their families back home. Can my friend file an abandonment case on her husband who is now studying nursing (and hoping to graduate in two years time and be back to Canada soon)? He´s now working here, living in a boarding house and has totally abandoned his responsibilities to his wife and son. How can we ban him from applying re-entry in Canada? What must my friend do and where must she submit her complaint letter? Please help us. Thank you.

hang on, I am confused. do I have this right -

2 married people from the Phillipines have left their respective spouses and married each other in Canada without first divorcing the original partner.

this woman he married in Canada is waiting for her PR status. how did she enter the country? did she sponsor this man? If she did, they have both committed misrepresentation.

the man... I guess the 1st wife can report him to CIC. She will have to prove they are married. the abandonment issue is something that is outside Canada´s jurisdiction.

the whole thing sounds like a nightmare.

yeah, it´s really a nightmare for my friend and she wants to make even by banning her husband from going back to canada after finishing his nursing course here.

the two people involved just lived together, i think they´re not married in canada yet. the girl´s been there for four years now and they met last aug.2006, 2 months after the man arrived in Canada. if and when the girl gets her PR status, can he claim my friend´s husband as her sponsored husband and forget about her true husband? that, i think is the motivational factor why the man does not want to go back to his own family...he badly wants to go back to canada whatever it costs him.

thanks sharon, just don´t know how to go about reporting the man to CIC.

if Canadian PR has not begun a sponsorship application she has not done anything wrong in the eyes of Canadian law.

as for the man... well... as a woman I know what I would like to do with him but it has nothing to do with immigration. More to do with physical mutilation.

OK. so, the only thing I can imagine that can be done is to send an alert to the Canadian embassy to watch out for this guy. I am not even sure if they will pay attention to it, but you won´t know if you don´t try. You would need his full name, passport number etc.

in the mean time, what recourse is there in the Phillipines for abandonment? that is the first round.

thanks so much, my friend will just have to watch out if her husband offers her an annulment anytime soon. that would mean, the girl in canada is already sponsoring him!

one more thing ms.sharon, is there really an "UNTRUSTWORTHY" evaluation given by immigration to a denied applicant? and if there is, how will this affect the man´s attempt on re-entry to Canada through working visa as a nurse?

no. it is misrepresentation or nothing. he is married or not married. in a relationship to obtain Canadian status or not. there is no judgement on whether the man is a jerk - God gets that one!

may i ask what can do if my husband who is in Canada for almost 4 years is living with another woman and now they have a child? My husband is not communicating with me for 3 years and he even not give some money for our son. He is in Canada with a single status.please help me...

when he went to Canada did he say on his documents he was married and had a child? If no, you might be in a position to alert authorities that he has misrepresented his status. If he is married to another woman while still being married to you - he has a marital status problem as well. Reporting him will not get you financial support. You would have to take him to court in Canada. Unless you are also in Canada, there would be no way to enforce the matter.
