Subject: Domestic/Out of Country
 
Hello everyone.

I will be marrying my girlfriend/fiance of 3 years this coming
January. She is Japanese. We will apply for immigration right after the wedding, yet we still cannot decide whether or not to use a domestic application or out of country application.

CIC has hinted to some answers that we need to move forward with our
application. However CIC has not helped us to the point that we are
comfortable in making the decision to apply domestically or out of country.

If we apply domestically, will my fiance need to go through an interview?

Can we apply for an out of country application if she is living in Canada?
Also can we choose which viza office to apply at, such as Seattle or Buffalo??

We have been helped by an immigration lawyer, this person recommends
to apply domestically. However some information we have gathered has shown that the domestic application can take much longer to process than the out of country application.

I have also been given conflicting responses when asking if we are able to send our application to Buffalo or Seattle instead of Manilla.
Seeing as Manilla has one of the slowest processing offices on the Pacific Rim.

I also understand that an interviewing process is very likely when applying using the out of country application.

Any help would be greatly appreciated.
And if anyone has any questions of your own, please feel free to ask.
We have been researching for the past two years.
Yet even up to this point I have yet to feel comfortable with any one answer.

If anyone has already sponsored a Japanese spouse I would greatly appreciate any help you give.

first, congratulations on your upcoming wedding.

I am assuming both of you are currently in Canada.

1) interviews are determined by additional need for information or verification. There is no way to determine if CIC will make the request - the only thing I can suggest is to insure your application is complete, and the relationship is well documented

2) I am a little surprised that an immigration lawyer would recommend inland applications at the moment - a) they are taking much longer to process and b) there is no option for appleal if CIC turns down your application

3) inland applications go to Vegreville for initial approval of sponsor (you) and then they go to Buffalo. Once they are in Buffalo, they will be internally transfered if CIC thinks it beneficial.

4) out of Canada applications go to Missisauga for sponsor approval and then to the home country of the non-national. I am not famililar with the wait in Manilla - but you should weigh the 2 for comparison.

5) on an inland application you have the option to apply for a change in status which eventually allows your fiance to work in Canada (unless she is here already on a work permit)

there is a forum called Road to Canada that has a large contingent of spousal sponsorship applications - both inland and out of Canada. give it a try... you may get some additional insight.

I thank you very much for your prompt and very helpful
response. I know this post had a lot to take in, so I also thank you for your time.

I still have two questions. Do out of country applications go to Buffalo? I was on the phone with CIC and they said that the two locations that out of country applications will go to is Buffalo if my fiance is living with me here in Canada or Manilla if my fiance is living in Japan.

I noticed you said that inland applications will be processed in Buffalo and the sponsorship application for inland applications will be processed in Vegreville Alberta. I just would like to verify.

My second question is, will my fiance have to leave the country for 2 months when we apply for the out of country application. She is living with me in Canada right now.
