Subject: Landing questions!
  Hi all,

After 2.5 years, I finally have the PR visa attached to my passport (expiry date is Aug 08). Now my problem is I just started a 2 years work contract and not likely I can leave by Aug 08. So...

Q1. Can i apply to extend the given time on the visa?
Q2. I plan to go back to canada for a 2-week visit (vocation only not landing), will there be a problem?
Q3. Say once I´m ready to move over for landing, how long do i have to live there before I became a real PR? 2 out of 5 years or what?

1. Visa once stamped cannot be extended.

2. You can go for 1 day even. Just land and come back but the border official may refuse to process the PR card if the knows, you will have to apply for travel document in this case for any future travel to Canada (easy to get). However, he does not need to know and you can give your friend´s address.

3. Once you land you become a PR. You have to stay for 730 days out of every 5 years to maintain your pr status. 1095 days out of 4 years will get you citizenship.

Hi Samm.

Re Q2. You mean even if i go for a day, they will consider me as landing NOT traveling? If so, also means 730 days out of 5 years will start counting?

Re Q3. (1) What´s the difference between PR and citizenship? (2) I previously studied & worked in Canada for 8 years already, do I still need to spend the same amount of time to maintain PR and get citizenship?

Yes, if you go to the port of entry, show your pr visa and COPR letter, you will be granted PR status. Yes you 730 days out of 5 years will start from that very day itself.

Citizenship has no residency obligations. You can vote, work in certain organizations where only citizens are allowed to work, almost no restriction to travel as you will be holding a Canadian passport, etc.

Time spent before getting PR on a valid study or work permit is counted as half upto a maximum of 1 year for citizenship requirements.

For example, you get your PR on January 1, 2008 and you were staying in Canada on a valid study or work permit from January 1, 2006. You will be eligible to apply for citizenship on January 1, 2010 if you continue to stay in Canada.

I hold BNO passport where no visa is required to enter Canada as traveller. So if i goto Canada in Jan 08, can i show you my passport instead of showing them the PR visa and COPR letter? My purpose is I don´t want to start counting 730 days out of 5 years until right before my PR visa expires.

Isn´t your PR visa in your passport? How are you going to hide that. The question i would ask here is if they see your PR visa can one say that i don´t want to land today. I would think that depends on the IO.

If i was in your situation i would land in July 08, come back, finish my contract and move there permanently.

Yes i want to land in july/aug 08, but i want to goto canada in jan 08 for 2-week for vocation. Not sure if they´ll allow me not to land at that time. Because i was told once PR visa is received, landing is required the next time i goto canada (before the visa expiry date).

that is also my understanding - once the visa is in your passport, you must land the next time you cross into Canada. (within the expiry window)

be very careful what you tell border services when you land. They are not taking to kindly to long delays in settlement. A few months to wind things up but protracted delays simply because you have better opportunities elsewhere could create some push back.

do not mistake the expiry on your passport to be the same as your window to land. Landing deadline should be outlined in a letter with your passport. it may even be on the actual visa. It is generally 1 year from the date you took your medical exam.

should you neglect to land within the prescribed time, your PR will be cancelled.

I GOT MY PR STATUS ITS VALID TILL 8TH FEB-08, I AM PLANNING TO LAND IN JAN MID, IS THAT IS THE SUFFICIENT TIME TO GET MY PR CARD DONE SND I AVAIL MY RESIDENCY STATUS AS MY MEDICAL IS VALID TILL 8 TH FEB??
