Subject: left the States on H1B to Canada
  Hi guys,
I hope someone can help me.
I worked in the US on H1B, but applied for immigration to Canada and moved out. I want to visit US for couple of days. I still have my entry visa with the H1B status till 2009, but do I need to apply for a new entry visa from Canada or somewhere else to get into US. I´m in a bit of a wonderland here.
Thanks for your help in advance.

If ur US visa is valid with multiple entries, u don´t need another visa.

As far as I know once you stopped working in US your H1B visa is not valid anymore and you must leave the US within 10 days.

Therefore I am not sure if it is OK to travel with your "valid" H1B if you do not work in US anymore. I may have the same issue in a near future though in my case I don´t need a visa to travel in US so I am not bothered too much.

Dara,

If you left the job in the US for a substantial amount of time, likely 21 days then their system already canceled your H-1 status. For all foreign workers they detect the long absence by tax information. No matter the validity of your passport stamping you wouldn´t be eligible to re-enter into the states. NEED to have new tourist visa.

If you now try to enter into the US pretending to be a H-1 worker then you even most likely will be treated with dual intention and may get a bar. Very careful.
