Subject: TD visa to Permanent Resident in Canada
  Hi,

I´m a Canadian citizen working in USA on my second TN visa and got married this year. My wife got her TD visa from the USA embassy in Bulgaria and joined me here in USA coming straight from Bulgaria.

While being here in USA, she applied for her permanent residence in Canada and she will get her immigration papers for Canada soon. She wants to get her PR card as soon as she gets her immigration papers but we are not intending to move back to Canada permanently until my contract in USA is over (not soon!).

What´s the procedure for her to get the PR card and then return to USA on a TD visa again? Do we need to surrender our I-94´s when we enter Canada and ask for a new TN/TD visa when we return to USA? Can we return to USA the same day or she has to wait in Canada to get her PR card first? (we have a mailing address in Canada where the PR card will be sent.)

Process is very simple.

If your TD visa is still valid, and returning to us within few days (5/7) then need not to surrender the I-94. If not, then she has to surrender the I-94; take TD visa again from the US consulate in Ottawa. NOW, she has to wait to get her PR card in hand to get the neew US visa as US doesn´t allow her to get visa without the PR status.

She can land and return the same day if still has valid US visa. BUT it´ll take about a month to get her PR card. She can wait or have someone to send that to her in the US.

There is no special procedure for PR; same as long as you have the valid US visa to enter.

We are planning to drive together up to the border and there she will apply for her PR. The Canadian immigration law says that since I am the sponsor and working in USA I am allowed to sponsor her with the condition that at the time she becomes a PR in Canada I am living in Canada.

Do you think that the customs officer will ask me to prove that I live in Canada at that time?...and if that is the case maybe the Canadian customs officer will ask me to surrender my I-94 and her I-94 (so in this way we are showing our intention to settle in Canada). Anybody else had this experience before? Can you please share your experience here?

You are correct. You have to move to Canada upon her PR recieving. Though I´m not sure, never heard anyone´s experience about how it really works. Most confusing thing to me is, OK you´ll come to Canada. For how long??? Landing with her and leave Canada the very next day? Canadian law can´t prevent any citizen from going/working abroad.

The immigration law says only that you have to live in Canada at the time when my wife will become a PR, it doesn´t say how long I have to stay in Canada before I move back to USA(so it is confusing).

On the other hand,once she get her immigration papers she has to enter Canada in max. 6 months otherwise she loses her right to become a PR. What if my contract doesn´t end sooner than 6 months (I´m on an open contract now)?I think she should be allowed to get her PR before my contract ends and then return to USA to live with me (the same day) until the end of my contract and then we both will move to Canada.

Anybody else had to go through this?I would appreciate if you could share this experience with us!

I never got any clear response on it.

Very confusing.

Though, it is assumes that you have to settle in Canada to support whom you sponsored. But on the other hand you are free to leave/work overseas as a Canadian citizen. Govt. has no control over that.

So?

Foor you wife I don´t see any problem. She can land as a regular PR, I´m not sure whether she can land alone or you have to be with her. Sounds weird though.

You are right Departed_Canadian! It is very confusing!

I will be in Canada when she will become a PR and support her for the length of her stay in Canada(could be a day or two)...BUT then I will return to USA together with her and here I have the same obligation since she is on a TD visa(which is a dependent visa) so I will have to support her here as well ...

Departed_Canadian, how do you suggest that would be the best when she will become a PR, both driving together up to the border and entering Canada at the same time or me going first and then she will follow me the next day entering Canada by herself?
