is it possible me to appeal after 3 months of receiving refusal letter

IT DEPENDS ON THE TYPE OF APPLICATION YOU WERE REFUSED ON.

There is always another way to get around regulations. If this is a spousal sponsorship refusal the IAD own rules helps all appelants.

Try to find out where you think that you should have more points and give some proofs with it if possible.

Usually this situation is not good. But you can always try. Did you get enough for English ? Do you think you should have got most ? Prove it!

Is it a lack of work experience ? Then just wait one or two more years ...order your caips and find out where you think they got wrong!

I stand to be corrected but I do not believe Skilled Worker applicants are eligible for appeal. You would be better off spending the time and money moving forward with a new application on the assumption that you can make up those 4 points you are short.

By your response to CBV333 it appears you allowed the Visa Officer themselves to assess your official language. Why did you not pay for the actual IELTS exam?

There we go. So it is your English the problem.

I agree with Roy. Maybe you did take the IELTS and you did not score enough .... perhaps you did not.

Now that your case has been refused I don´t know if you can appeal but you can certainly correct that "mistake" and perhaps re-apply again or send them the results of IELTS and ask if they can consider it.

NOTE TO ALL FORUM MEMBERS - proficiency letters in English or French are a risk, especially if you need full marks to reach 67. Pravin has just learned the hard way and I am sure he would highly recommend that you spend the money to sit IELTS.

I would sit the IELTS test now. IF you get the points you need, appeal to CIC to reconsider (it is not a formalized appeal process). It is worth a try. If you don´t get the points you need - well, you have your answer and something to work towards in your next application.

I do not think if he do the IELTS test now and pass he can ask CIC to reconsider.The decision has already been made by CIC and there is nothing like "Reconsider" or "Appeal" at CIC for skilled workers.
He can appeal to the Federal Court for a Judicial Review but this is an expensive process and from the limited information that he provided, it would be fruitless.
So as some said here, the best thing for him to do is to do the IELTS test and submit a new application.

No matter what Pravin, you should sit the IELTS. If you get the 14 points you need, then go ahead an reapply. Taking the test will let you know immediately if you are wasting your time and money to go any further OR it will let you know what must be done to make it all happen.

Balwant, I suspect you are right about it been too late, especially when we are at 90 days and there is still no date set for IELTS. They close those files pretty quick.

Do you think there would have been any time for CAIPS to flag the point deficiency before the refusal letter was sent?
