Subject: Marrying a Canadian
  Hi,

Me and my girlfriend used to both reside in the United Arab Emirates.
Im Algerian, and she is Canadian. I am currently residing in
Algeria, and she is still in UAE. We are thinking of getting married
and residing in Canada.

I am thinking of getting a visit visa to Canada, then getting
married while I am there. Is it possible to do that ? and if yes,
how much time would it take for me to get the PR status ?

First, you need to get that Visitors Visa. You will need to show ties to home and reasons to visit - including a letter of invitation.

I will warn you now, it is not the easiest thing to obtain. My guy lives in the country just east of you, and he was declined 3 different times. He finally had to show a house, a job and money in the bank before they would let him come. We made no mention of a romantic relationship - if you do... forget it. CIC will assume you have no intention of returning home at the expiry of your visa.

If your future wife is not a citizen, she must be living in Canada to sponsor you.

If she is a citizen and living out of the country, she can sponsor you but they may look poorly on an out of Canada application where the husband and wife are living in 2 different countries. You would have to do a lot of convincing that the relationship is genuine and not purely for immigration purposes.

Waits for PR status on an inside Canada application are about 12-18 months at the moment. Highly dependent on police background checks and the cooperation of the countries where you have lived during the past 10 years.

Outside of Canada applications are subject to the same checks but they appear to be taking less time.

Bur after he is there , will it be a problem for him to stay there ? as he entered the country as a visitor , will it be ok for him to change his status as permenant after marriage ? or they will ask him to go back to his county and apply from there, etc ...?

there is no such thing as changing your status to permanent in the way you describe. He must be approved to stay by CIC. That takes time, paperwork, legal documents, police clearances, fees and proof of the relationship.

If he is able to arrive in Canada as a visitor and gets married, the couple can begin the sponsorship process - as long as the Canadian is living in Canada. I would think the application would be problematic if the couple was living outside of Canada in two separate countries.

His status must be ´legal´ at the beginning of the sponsorship application. If it lapses, he can remain in Canada until it is complete. He cannot work until he is approved in principle - this could take about a year. The Canadian will be required to sign a contract of support for 3 years.

If the Canadian is living outside of Canada, he cannot remain behind without her.
