Subject: Visa for my fiance (from China) to Canada
  Hi everyone,

I´ve been researching quick a bit in reguards to what is involved in gettng a visa for my fiance to come over to Canada. I´ve went to both the Canadian and Chinese Embassies & Immigration websites to find out what is involved & best way in applying for a temporary visa for her to come over to Canada.

1) Canadian Immigration sites advised either applying as Tourist to Canada or private visitor (to visit a family or friends).
2) Spousal visa once you get married (either in China or Canada)

I was told by a friend of this forum sites and did quite a bit of reading in reguards to the topic. There are some confusing comments given by several people in what is the best ways or worst ways you may face in your application being refused.

I live in GTA area. I´ve meet my fiance thru a mutual friends thru MSN. We known each others for about 1.5 yrs now. I´ve been to China to visit her 3 times in the past year or so. Even took several vacation trps together to Thailand, Shanghai, Hong Kong, etc... Last October 2006, my family and I all went to China to officially propose to her (with her family´s blessing of course). I´ve just returned from another 2 wks vacation to see her last week. We are both Asian in ethnic. I am a Canadian citizen and she is Chinese. Our idea was to have 2 wedding ceremoney coincide with one another both in China and Canada for both families. Our idea was to apply for her to get a temp visa, that way, she will be allow to enter Canada after we get married in China first and then come over here for the 2nd wedding.

I am in the process of writting a "letter of invitation" to be submitted with the rest of all my documents below for her to applied:

1) Original Invitation Letter with details of my family members
2) Original 2006 Tax Assessment Doc
3) Original Letter form my empployer of my income and work status
4) Copy of my Canadian Citizen Documents with photos
5) Copy of my Canadian passport
6) Copy of my Ontario Drivers License, Health & SIN Card
7) Copy of our MSN & Yahoo Conversation Records
8) Original photos of us, family, friends - during my trips there.
9) Origianl Travel Doc (plane tickets, hotel bills, etc)

Questions:

1)From what I read here on the forum. That her application will be "REFUSED", if she applied in China as my fiance or girlfriend to come over to visit me here in Canada and get married here. Is this correct?

2) That her application will still be refused if she applied as a private visitor or as a tourist with the above proof? Based on the facts that she is already my girlfriend or fiance.

3) That the possibility of us getting married here in Canada is out of the question, as she will not get a temp visa to enter Canada based on question 1 & 2. Is this correct?

4) The only solutions that I get from all these researches, is that, the only way I will be able to get her over to Canada officially is to get married in China first. Then, applied afterward for a spousal visa instead. After providing proof again. Is this correct?

5) Applying either as a tourist or private visitor is futile as her application will be refused, when CIC finds out we are engaged already and in a relationship?

I´ve read many suggestions and recommends from this forum and other sources. Everyone have different answers in what is the best ways to proceed and what to avoid from getting your application refused.

I know, that people on this forum are also current or former immigration officers. Any recommends in what should I do in my situation from them would be appreciated. Any recommendations from people in the same situation as I am would also be much appreciated too.

Tony,

Let me keep it simple here.

If you explain the way you are doing it in your invitation letter, more likely her application will be refused, just because it is clear that she has no intentions of going back to China.

If she obtains the visa, in the port of entry in Canada she will have to probe that she is coming to Canada only on temporary basis if she can´t probe it, she will be refuse of entry.

You see, it is kind of risky. If you get married outside of Canada you may sponsor her to come to Canada as a Permanent resident. You can stay with her in Canada until the process is done or you can come back home. Either or...


Applying from outside of Canada is faster, safer and once the process is succesfully done, she will be able to come to Canada to live and work here.

Thanks Bill for your replies.

It is difficult to understand why CIC would refused her temp or permanent visa, as our intention (with proofs) is to get married and for her to live with me here in Canada eventually. I understand that CIC is wooried that she would not leave once her temp visa is expired, even if we did provide them with proof she will return afterward. Then, we would applied for a spousal visa. It seems more to do with red tapes more than anything else.

Few more questions:

1)Any suggestions about going the route of a tourist visa instead? Either by herself or with a tour group? Few people has mentioned this as another options too.

2) If we do end-up having to go the route of getting married in China first and then applied for spousal visa.

Any advices from people who has gone this route? What steps is needed from my end and her end? Who to contact to get the neccessary documents (both here and there) to get married in China?

Tony,

The reason of refusal is for the criteria that CIC will use to asses the a turist visa application.

Anyone who wants to visit Canada on temporary basis is going to be asses under the criteria that this person is a potential illegal immigrant until she/he can prove CIC wrong.

That´s why the applicant has to demostrate that they have ties to their home country and have no interest of staying in Canada other than for a temporary visit.

If there is anything that can make the officer think that this person wants to immigrate to Canada on a visitor visa, more likely it will be refused.

As a PR though is a different criteria. As a family member they have to demostrate to the CIC officer that the relationship is genuine and is not an excuse to immigrate to Canada.
