Subject: Open my own company to Meet Residency Obligations
  Dear All,

I received my Canadian permanent resident card almost 2 years ago. Since then, I have not been able to go and work in Canada and I´m currently employed in the United States.

In order to meet my residency obligations, is it possible for me to start a new company in Canada, show myself as the employee/CEO - who is currently employed by a Canadian firm but working in United States?

Would that I allow me to continue meeting my residency obligations? I understand it might be expensive but I do not want to lose my Canadian PR.

thank you for your reply

if it is even possible, I would suggest it is very risky. My understanding is you need to show bills that would establish your residency in Canada. If you are the sole employee of a company that is 100% owned by you... CIC will know exactly what you are up to.

I think it is likely time to make some tough choices. The Next 2 out of 3 years must be spent in Canada.

Seems like you do want to continue living in the US. I do not see why you want to keep your residency in Canada when your intention is to stay in the US.

I do want to move to Canada but I cannot do that for another couple of years. My current job is in United States and they are not sending me to the Canadian office. I would like to leave my job after I had been promoted to the next level which would happen in a couple of years. By then, I would be in a deep mess with the Canadian PR.

I also do not have a US green card and that will take forever. So I´m thinking of some way I can maintain my Canadian PR.

actually - I will not be the sole employee. a couple of friends/relatives will also be employees and we will even actually try to see if we can get some business. however, all of the employees will be based out of Canada.

anyway - does anybody have a link to where I can find more information on this topic from the Canadian government?

YES

Your fine as long as you meet the definition of the regulations section 61 (1), (2), (3)found here. http://laws.justice.gc.ca/en/showdoc/cr/SOR-2002-227/bo-ga:l_5-gb:l_2//en#anchorbo-ga:l_5-gb:l_2

Pay your Canadian Business Taxes and all will be okay.

If I remember I will post a more detail response if I have time today when I get to the office.
