Subject: Canada Immigration
  Hi I have been offered a job in Canada as a skilled worker, however, I am at the age where I am considering going it alone and opening or buying a small business, if I initially accept this offer and go to Canada do I have to take the job or could I decide to resign soon after arriving and to go it alone, or take another job, what are my rights?

I think the confusion comes from your use of the term " skilled worker". Skilled worker is one category of the schemes that allow you to immigrate to Canada. It is a lengthy process that can take 2 years or more. Once you are successful, you enter Canada as a new PR of Canada. In this case you will be free to take any job or do your business according to the Cnd law and regulations.

But, if you mean you have been offered a job in Canada and the visa is given for that particular job, then you are a temporary resident of Canada, not PR. In this case, you will have to abide by your terms and conditions of that particular job. You can be in trouble if you intend to violate those terms and conditions of the job, because you were brought to Canada to do this job. As British national you do not need visa to enter Canada. However, you are still a visitor of Canada if you decide to come this way.

If you are on a work permit then you have to respect the conditions stated on your permit. Most likely your work permit will be tied to the employer.

What are the likely conditions that will be imposed, I don?t want to uproot my family to Canada and find that I don?t like the job or the management, how long am I tied to my employer?

There is no time limit to being TIED to that particular employer. Normally a condition is that your not allowed to go to school unless authorized and that you can only work for the employer named.

You are being granted admission based on a LMO or Labour Market Opinion that allows the employer to hire a foreign national.

If you choose to change employers you will have to apply to ammend or change your terms of admission and are not suppose to start working for the NEW employer until CIC approves your revised application.

If you want to start your own business you can do that based on the laws in the particular province you choose. Then you could even seek out a LMO to work for yourself.

Make sure you retain someone knowledgeable in this area.
