Subject: PR and marriage regestration advise needed!!!!!!
  My finance is Canadian permanent resident. I am here in US on student visa, my visas are expired but my I-94 is showing D/S instead of any expiration date. i am graduating this may, and i am planing to get married by Aug this year. Because of my visa i don´t want to take any risks and go to Canada for registration of our marriage instead of that i prefer to do that process here in US. I am a resident of NJ and have my apartment lease on my name. i have a social security number but i have lost the card.

If i get married to a Canadian permanent resident here in US, get my marriage certificate and then my wife sponsor me there in Canada would that be a problem? I mean can she file papers with our status? is it required to appear for an interview in country where the marriage process was performed? or i can appear anywhere even in my home country if i decide to go back after getting married. what process should i exactly follow to avoid all complication? and is it advisable to get married and register our marriage in our home country or it don´t create any significant problems.

Hi, You have asked a lot of little questions. I think I can respond to a few of them...

1) As I understand it, as she is not a Canadian citizen she must reside in Canada so as to sponsor you. Does she live in Canada now?

2) I believe that you can get married anywhere...the US, Canada or whereever. Just keep lots of evidence of the marriage, ceremony, photos, wedding invitation sample....Lots of bits to submit with your application.

3)Some people have interviews and some do not. We are applying outside through the UK and everyone that I chat with seems to have their interview waved. Your situation might require and interview. It all depends on where you apply to. All applications go to Mississauga, Ontario and then your finance/wife is either approved or denied to sponsor you. They will want to know that she is living in Canada and is single and free to marry. The second half of the visa is approved at an embassy that you choose....We are using London, you may want to use Buffalo. It is up to you.

4) You have to provide police certificates for all the countries and areas that you have lived in so by going back home you would/could need another police certificate.

5) I am not sure what to say about your expired student visa. I am sure that I remember a question about being in legal status in the country that you are applying from.

I am sure that others will have something to say. I have most likely missed a few things but I hope that this helps you out a bit....

1. In-Canada applications take longer than outside applications to process. you may wanna take this into consideration to decide where to apply from.

2. As analog....

3. Calling for interview is at the discretion of the processing officer. You may be called in your country of residence also not necessarily country of citizenship.

4. You can go anywhere. The Immigration process is not complex. It only takes a lot of time. If you have all your proofs (degrees, police clearances, marriage certificates, reference letters from employers etc.), then you are fine. Submit these as they request.

Keep good health and no probs in medicals as well

Your I-94 says Duration of Study (D/S) which means you should be a full time student to be legal in US. You may be in OPT for a year after you graduate. You are still legal.

You dont have to register your marriage in your home country. You may choose to. As long as the marriage is legal in the country where it was performed, you are good.

Get married and submit outside of Canada aka Buffalo. Since you have been admitted for more then one year to the States and you reside in the US regulation 11 would allow you to apply from there.

Make sure you show plenty of relationship type photos showing the two of you laughing and having a bond.
