Hi All,
I am Maulik from USA.I am in USA on H1B.I am in USA for last 6 months only.
I want to put up my immigration file from Buffalo office here in USA.
I am leaving USA in 15-20 days now as i dont have good job over here.But i want to put up my immigration file before i leave USA.
My doubt is...
1) Can i put my file from Buffalo office ?? I am here in USA for last 6 months only.
I have 3 years of H1B Visa till Nov-2009.
Please reply me as i want to leave USA soon.

You can file at buffalo since you have H1B for another 2.5 years. However, try to stay till you get AOR.

Hurry up man.. Give your friends address, so that he would be able to help. You are interesetd in spending money then I would recommend to hire lawyer and they would do everything for you.

My knowledge of the matter is that you have to file at the nearest canadian consulate of your country of residence. Since you live in the US, it seems OK to file at Buffalo.
However if you stop your job, as you said you have to leave, then your H1-B won´t be valid anymore (I am myself a H1-B I know this well) and the current "status of your country of residence" (one of the document you have to file) won´t be valid by the time they will process your case. It may not be a problem in itself but it looks to me that it may delay unnecessarily your application.
Remember they make a clear statement that you have to notify them of your change of address so what about your change of status ?

I RECOMMEND NOT USING A LAWYER SIMPLY BECAUSE YOU DONT NEED ONE. THE CIC PROCESS HAS BEEN MADE SO EASY TO ENABLE TO APPLY WITHOUT THE NEED OF LAWYER.MOREOVER WE HAVE ROY WHO GIVES ADVISES FOR FREE AND HE IS GOOD.
THIS FORUM WILL HELP CLEAR MOST ISSUES.

I am planning to apply in next month and then move out of USA.
I will give address of my friend as communication address and while i am out of USA i will do the communication with Canadian Consulate with help of my friend here in USA whose address i will give.
Will it affect my application anyway if i move out of USA ?? I am planning to go to Europe for 6 month project...
Do i need to inform them about my change of location ??
or is it ok if i come back to USA on visitor Visa at time of Medical and if in case they ask for interivew ???
Ur help to resolve this doubt is required....

You MUST notify the CIC of your new address.
You can apply at the Buffalo Office.
It depends on the Visa Officer´s mood. He may or may not transfer your file to your country of residence.
I moved out of US right after applying.My file was processed at the Buffalo office. I know people whose file was transferred to their home country when they left US.
If you notify CIC of your place of residence, they will send you medical forms and you may take the medical exams in that country. You do not have to come back to US. I did my medicals in the Middle East.
You must NOT lie to the CIC at any time. If an interview is called you will be safe if you keep notifying of your address everytime it is changed for whatever reason. You dont need to notify if you are going to a country on a vacation for a few weeks or so.

You don´t need a lawyer and Roy is there who gives good advice for free.
If you manage to be in US whenever it is required, it could work, it would be easier if you keep moving around the world in fact. You said 6 months in Europe then where would you go afterwards ?
I would personally recommend to inform them about your whereabouts, since they are going to make a throughout background check about you it won´t look good if you have hidden something.
Am I right ?

Well i am planning to apply for file in 2 weeks...
Then planning to go to Europe for 6 months on a project..Then if the project will extend then i will be there for 6 months more...
So...i will notify them once i reach Europe.....Thats what my plan is ....
If God & Luck favours me then my file will be processed from USA only and will not be trasffered to my country of residence(India)....

Good! That is what I would do. Inform them when and where you are in Europe and send them a copy of your visa and reason why you are in Europe, I guess it is up to them if they transfer your file, just keep them INFORMED. And if your visa gets renewed after 6 months, again let them know.
If you live in Europe, your country of residence becomes the country where you will live in Europe, not India.

Yes, you should hope for the best but be prepared for the worst. Lets hope your file will be processed at Buffalo.
