Subject: Can spouse apply for PR right after he lands
  My partner is comming over from England on a Bunac Working Holiday Maker in about 5 weeks to be with me and our daughter. I really want to get his PR or citizenship sorted asap so we dont have any suprises when it comes to the end of the allowed year he has.
I´ve been in England for just under 2 years and we have documents with both our names on to say that we are an item and letters and pictures.
So ...
1)when he lands can we start the process for him to apply straight away. Do they take into consideration that UK is commonwealth?
2) what would be the best option? PR or spousal sponser (I´m not working yet, still taking care of 7 month old, basically waiting for Partner to get here so we can alternate hours)
3) would they really be as heartless to seperate a man from his family?
We´ve had help from this site before and It was so helpful especially from Roy.

I think I have responded to your spouse before.

Nothing will go wrong IF your application is complete.

IF you include in your story that you returned and he could not live without you and your daughter and he decided to step up to the plate and FINALLY say "Will You Marry Me" or something along those lines, all female Immigration Officers who have been waiting too long for their man to say those words will understand.

Include lots of photos showing just how super a dad he is, a request for an open work permit at the same time a IMM1249 and live happy ever after.

If you wern´t virtual I´d hug you.
And you have responded to us before. You have been such a help.
I´ll start the PR straight away then and do the IMM1249 at the same time. I almost feel guilty taking all your time and advice with nothing to give back. Do you do one on ones like an immigration counsellor or lawyer?

Hi Denise - If the two of you have documented proof that you lived together in the UK for at least one year it is not necessary for you to get married first in order to sponsor him in the Spouse/Common-law Partner category. In addition, don´t waste your time filing an inland application and bothering with an open work permit application. Your partner does not HAVE to apply inland just because he will be in Canada on a BUNAC visa. Every foreign national has the right to apply through the visa office that represents their country of birth/nationality. If he is a UK citizen, his file would be processed through London - he could be approved for PR within about 6 months, whereas an inland application will tie you up for 12-18 months. The only downside to London processing might be if you were required to attend an interview to verify the authenticity of your relationship and/or the common-law qualification - it would be held in London and, most likely, the both of you would have to attend. You may also have another option available, too. IF the BUNAC holiday visa qualifies him as having been "legally admitted to Canada for at least one year", (I´ll find that out for you and post again) he can apply on an outside application using his/your address in Canada. This causes the application to be routed through Buffalo - comparable processing times to London - which, depending on where in Canada you are, may be closer for you than traveling to London.

Whichever way you proceed, there are a few things he should take care of before leaving the UK. He should get his criminal clearances done, and he should gather whatever documentation the two of you might still have in the UK that proves your relationship and common-law qualification. In addition he will need a copy of his birth certificate and, of course, a valid passport. Once he´s in Canada he can get the medical exams done (cheaper here). IF the Bunac visa is issued for at least one year it will qualify your partner to apply on an outside application using his/your Canadian address and the file will be processed through Buffalo. If, however, it´s issued for a year less one day, as some are, he will not have been legally admitted to Canada for at least one year - and therefore, would not be eligible to be processed through Buffalo. This doesn´t mean, though, that he can´t file an outside application through London - that is always possible.

If, however, you decide to go with Roy´s recommendation and file inland - BE SURE that you include the application for an Open Work Permit that he mentioned. Otherwise, when your partner´s BUNAC visa expires he will have to leave Canada, thereby invalidating the inland PR application and forcing you to re-apply through London while your partner remains outside Canada. Filing the OWP application in the same envelope with the PR application gives the applicant implied status in Canada, so that if their current status expires (your partner´s BUNAC visa)before they have approval on the PR application, they are not required to leave Canada. It will also give him the ability to work while he´s waiting for PR to be finalized.

Answer to question 2:

If you are not working/claim social insurance, and sponsor your partner as a dependent, your application will be refused.

You cant guarantee that your ´story´ will be read by female immigration officers...
