Subject: Experience w/ criminal inadmissibility issues?
  I´m wondering how CIC will handle this situation: I am sponsoring my wife from the USA. She has a kid with an arrest six months ago in the USA which shows on the State criminal clearance - all 4 counts, even tho 3 were supposedly dropped and he pled no contest to the one. He was not sentenced to jail time, but ordered into an "out-patient" drug program for 18 months, after which his record is supposed to be cleared. But we need to file for PR now. We don´t know if his "crimes" will make him inadmissible, but worst case scenario they will and we will be asked to drop him from the application. Does anyone know how CIC will ask us to do this? Will we be asked for an interview - will this cause significant delay to our application? Should we include a cover letter with our ap notifying CIC that we know inadmissibility is a possibility and that we are willing to drop him from the ap (he doesn´t want to come to Canada anyway) or should we just be quiet and let them contact us?

Turned 18 two months before the arrest.

You should check with the CHC who is or will be processing his/her application.



Section 19 of Canada?s Immigration Act prohibits the admission of people who pose a threat to public health, safety, order, and national security. Prior to attempting a border crossing, American citizens who have had a criminal conviction in the past must contact the nearest Canadian embassy or consulate well in advance to determine their admissibility as visitors into Canada. If found inadmissible, an immigration officer will advise whether a waiver (Minister?s Permit) is possible.
