Subject: spousal sponsorship
 
Hi,

I received my permanent residency and my pr card in the year 2005. I was unmarried then. After tht i went to india for 1.5 yrs. During this time in india i got married.

Now I have recently come back to canada. I want to sponsor my wife.

Do i just need to use the spouse sponsorship kit given on the immigration site or do i need to update the immigration authorities in some other way that my marital status has changed during my stay in india.

Why do you think the spousal sponsorship kit is there if it isn´t for Canadian PRs/citizens to sponsor their spouses?

Yes you have to fill that in if you want her to come!

hi ... u misunderstood me. i know that i have to use the kit. what i wanted to know is that, do I have to do something in addition to this .. like intimating the department seperately that i am married.

i am thinking this becoz at the time i applied for permanent residence, I had given my status as unmarried.

You need to update your marital status as it changes, so the answer is YES, update marital status with CIC ASAP! Browse through your old pre-PR CIC paperwork, on the back of the AOR letter there is a "CHANGES IN PERSONAL INFORMATION" form for faxing/mailing CIC. If you can´t find it just write CIC a letter.

Do not file any application before you let CIC know that you are married. Filing for your wife prior to that will likely trigger some real "nasty stuff", such as your spousal application´s denial (how could they possibly approve your wife´s application if you are still "single"?!?), misrepresentation, etc., etc., barring you for life from sponsoring your wife.

Someone please correct me if I´m wrong!

this is really serious. maybe the best thing is that i speak to them directly and write them a letter.

I´m not sure this is correct if you marry after you´ve received your Permanent Residency and landed. Imagine if you´d landed ten years ago and got married yesterday - would you have to immediately inform CIC then or forfeit ever being able to sponsor your wife? A Canadian citizen does not have to inform CIC that they´ve gotten married before they can file to sponsor a spouse. I don´t know if a PR is required to do differently or not. But I do know that if you marry BEFORE you receive your PR visa - or even after receiving your COPR but before you land - that you ABSOLUTELY DO HAVE TO INFORM CIC IMMEDIATELY. If you land without telling them you´ve married, you will forfeit your right to ever sponsor your new wife. I read just in the past few days on another forum where a guy was in that situation. He had received his COPR but had not landed, and he´d gotten married. Wisely he informed CIC and they informed him that they were destroying his COPR and that he needed to ammend his application to include his new wife, and that she must be examined, etc. He was quite shocked, but this is normal procedure. At any rate, in your case, it´s probably not required but still not a bad idea ?(or too much trouble) to notify CIC of your marriage. Then file your sponsorship application. A relatively simple way, I think, to cover all your bases.
