Subject: Martial Status Change of PR/Citizen is a Must?
  My friend is a Canadian Citizen in Canada recently got married in US. He doesn´t need to sponsor her for PR (the girl already applied for professional class and medical has been done). My friend already sponsored his family 2 years ago.

Is it mandatory to inform CIC or Canadian Govt. about the change of his marital status?

Any help would be appreciated.

Normally, any person with a pending CIC application MUST update CIC in case of a marital status change! There are no BUTs and IFs, when your marital status changes you are due for an update.

I would say SHE has to update because her application is not yet finalized, while HE doesn´t need to update anything, since he is a Canadian citizen.

Someone correct me if I am wrong.

Thanks a lot Uniden.

I saw earlier couple cases here where the PR got married and didn´t inform CIC immediatedly. After sometimes when they applied for spouse PR, they were refused for the reason that they didn´t inform CIC on time.

This is a newer thing for me. I didn´t know that as a PR you are always supposed to update your marital status.

I am not sure what PRs need to do if their marital status changes. I only know what people with pending applications need to do, and that is to update CIC on any marital status change, without exceptions.

The guy is a Canadian CITIZEN, and she is a person with a pending application, not a PR yet.

For what I understand she hasn´t landed yet. Her application is still in process. She MUST inform to CIC about her new marital status.

To me, HER case is 100% clear.

Just not sure about HIS for the reason mentioned before (denial of spouse sponsorship).

HE does NOT need to update anything. He is a Canadian citizen.

Can you imagine all Canadian citizens flooding CIC with updates to their marital status if this were true? :)
Canadian citizens have the same status and rights as people born in Canada. They don´t need to report anything to CIC.

By the way, because HE is already a Canadian citizen, implicitly you cannot call him a PR (which is the status before citizenship).
..and SHE is not a PR either, because he application is still pending.

Yes Uniden I fully agree with you; just confused by the cases stated here. One of that was:

"My Spouse immigration application was recently rejected and I have been told that I did not informed Immigration when I got married and my Marital status was not changed earlier. But its clearly a miscommunication or lack of knowledge on my side, I did not tried to hide anything as I have used my actuall marriage date in the forms for over 10 times. I really did not had any idea that I had to inform CIC also when I get married.
But as now after 6 months my spouse application has been rejected and sent back to me, what are the further steps I should take, because I have to be with my wife and we cannot live apart from each other for a long time."

Shah,

That posting confused the hell out of me.. I still don´t know today what that guy´s status was when his wife´s application was denied. Probably PR, in which case he should have (but he hadn´t!) updated his marital status with CIC. He doesn´t say a word about what he has done to REALLY update CIC on that. Merely using the date of marriage on some forms doesn´t mean AT ALL that he had updated his marital status with CIC.
Has he updated his own marital status with CIC? Has he sent a copy of the marriage certificate to CIC? Probably not. But that is the only way to do it.

In any case, the lady in your story MUST update her marital status immediately! Don´t waste time!

Yes, She´ll do that for sure.

I was totally shaken by this post. This was something I think no immigrant usually think before starting Pr application for the spouses. In that sense, many hundreds would´ve been traped like him.

In my opinion, explaining why CIC rejects an application for spousal sponsorship when the main applicant hasn´t updated the marital status, is rather simple:

How can CIC possibly approve such an application when they still think that the sponsor is single?!?
Oh, s(he)´s not single? How would CIC know without an update?!?

Shah, please don´t be shocked by that post. He messed up by not updating marital status. Maybe he didn´t know how to do it or something, but whenever it comes to immigration, or legal stuff in general, not knowing something is not an excuse for breaking the law or immigration rules for that matter. This would have been a perfect example for someone in need of qualified, professional advice.
