Subject: Criminal Check Question
  I have immigrated to Quebec from the USA under a spousal sponsorship for Permanent Residence. I am in the final steps of completing the application to become a PM, so I was required to obtain a Background Check from the last state i resided in, as well as an FBI check.

I was under the impression that any criminal offenses or convictions committed as a MINOR would not be counted, or divulged on a state background check. I was told that upon turning age 18 the state would give me a clean slate, however, when I received my request for background check in the mail, I was shocked to see listed the felony offenses that I committed as a minor over 6 years ago. Is this correct?

Have I been misled into thinking my slate would be swept clean as an adult? If this is the case, and it cannot be challenged, what kind of impact could this have on my immigration application/status, and could it lead to a denial?

I´m surprised as I also thought that juvenile records were supposed to be sealed, but your questions brings up another question for me - my eldest son was arrested at age 17 on a DUI. Because it doesn´t show up on his clearances, and it was a youth offence, I was thinking that I wouldn´t have to declare it on the forms going to CIC. I´d actually forgotten all about it. But now I wonder if I have to disclose it, even though it doesn´t "show up". We haven´t gotten his FBI clearance yet so I don´t know if it will show up there.

I´d suggest your read Section 24 at this link http://www.cic.gc.ca/manuals-guides/english/enf/enf14e.pdf for more information on how they handle offences under the Youth Offender Act, and that you contact the defense attorney that handled your case to find out why it´s showing on your record. It´s possible it could render you inadmissable to Canada until after rehabilitation - which is something like 10 years after the date you completed your sentence, but it will depend on what the offence was and how it fits in with the YOA. I found additional information at http://lois.justice.gc.ca/en/ when I was researching info for my son´s arrest. You can get info there on where your particular offence falls "falls" in regards to inadmissability. If I were you, though, I´d get a lot more information before I submitted those clearances to CIC. You´ll want to know what you´re up against, and do what it takes to clear the report if you can, before you apply.
