Hi, I´m a canadian citizen currently residing in the U.S.A. under f1 status. I recently got married to a non citizen neither from the USA or Canada he is also here as a F 1 student. My first problem is that his student visa is out of status. I am looking to sponser him in canada but i would like to know does his status effect the application? Do I need a minimum amount of income to sponsor my spouse or could I go forth as a student sponser? How long will the process take and if you know of any good lawyers in windsor Ontario or if a lawyer is even required through this process or would it help if i had one..?

(in reply to: Roy Please Help) hmmm, I am not Roy but I will try:
1) As a Canadian citizen you can sponsor your husband while you are residing outside Canada.
2) You do not need to meet a minimum income in spousal sposorship but some evidence that you would come back to Canada once he is approved for PR.
3) His status in US would not affect his sponsorship process, as long as there is no other issue in the admissibility backgrounds. Also, I guess he entered USA at first time legally.
