Divorce a sponsored husband

Subject: Divorce a sponsored husband
  I´ve been married for about 2 years now. My husband arrived about 8 months ago. We´ve both decided that we are not meant to be together and it´s an amicable decision between the both of us. This is both our first marriage. Hence, noting the responsibility I have is not a concern but we wish to know what is the best way. We decided to separate although we live together. I know I have a 3 year window where I am responsible for him yet we both agree that divorce is the next step. Do you sudgest we wait it out 3 year then file for a divorce. Would I get penalized if we do it before hand. I don´t want it to effect him and his chance of loosing his PR or the opporotunity to get his CC. Thank you.

The only penalty is that you will not be allowed to sponsor anyone else until you meet the obligations under the first undertaking.

The penalty Roy was talking about only applies if your husband will apply for government assistance such as welfare.

Roy,

I´m not too concerned about the penalty. I do not pan to sponsor anyone else. At this time I trust that he would not go on social assistance since he has a good job for somone who has just lived here for 8 months. I just feel so terribly bad that it has to be this way. At this time I think it is better for him to stay in Canada and work on adapting to the Canadian way of life. It´s better for him then going back to his home land. Which he was considering. If he decides to go back what would you sudgest. I told him it is better for us to divorce before he goes back and informed him it is better for him to stay until he get´s his cc and have some stability then decide if he wants to go back to his home country. At this time I want him to continue staying with me until he´s more settled. What is one to do I´m at a loss of words. Thank you everyone for your input.
