Hello Guys.
I am from Pakistan. I am in the US, currently on H-1b status. I change from f-1 to h-1b. Sincet then I never visited pakistan. now I want to go to canada for landing. Am I eligible for auto revalidation. My stamped F-1 visa is still valid till oct 07, but i guess it does not have any importance now. If I do eligible, what kind of documents , I need to take along. My wife also accompanies me.
Thanks
KK

(in reply to: auto revalidation rule URGENT PLZ??) Hi,
To be eligible for auto revalidation you need to have an expired visa, a valid I94 and should not have appeared for a visa interview in Canada. Also you should be returning back within 30 days.
I would say that since your visa category has changed, while returing the officer at the post may not be sure how to handle this case. you may be stamped a cancelled without prejudice stamp at the post and may not have a visa at all to return back. To avoid complications at the post its best to return to home country get a fresh visa and attempt the landing.
I am writting this after talking to US visa officers few days back since I too am in a similar situation.

(in reply to: auto revalidation rule URGENT PLZ??) I believe - you should be okay if he is having i-797 document with him.. they will not stop you as long as you have I-797 .. happy landing...I am in same situation..

(in reply to: auto revalidation rule URGENT PLZ??) As far as I knew, you must have to have the same status Visa stamped in your passport. As an example in your case, must be H-1, not F-1. So you better be very careful.
If you were still a valid student with expired F-1 visa in passport, then you would be OK.
But now You are in H-1, but have F-1 in passport (valid/no-valid doesn´t matter). So, auto-revalidation doesn´t work. If you leave USA, you have to take H-1 visa in passport.
