Subject: marriage immigartion law
  Dear Sir,
I am 19 year old Indian visiting U.S. I have been here for three months and will leave in december.

I have my girlfriend living in Ottawa and she came to meet me. Now we are planning to marry. The problem is that according to Indian Marriage law legal, age for men is 21 and women is 18. So i am not able to marry under that law. She is also 19,Indian born Canadian citizen.
But according to U.S and Canadian law people above 18 can legally enter into marriage. As i am now in U.S then i can marry.

I want to know if its legal for me to marry in U.S now and can my girlfriend sponsor me from Canada? Will the Canadian immigartion authorities consider that i have not abided the Indian law or as have married under U.S law? or should we wait for 2 more years?

PLease help me with this very important issue. All your views and suggestions will be appericiated.

Regards to all of you.

Spouse
You are a spouse if you are married to your sponsor and your marriage is legally valid.

If you were married in Canada:

You must have a Certificate of Marriage issued by the province or territory where the marriage took place.
If you were married outside Canada:

"The marriage must be valid under the law of the country where it took place" and under Canadian law.
A marriage performed in an embassy or consulate must comply with the law of the country where it took place, not the country of nationality of the embassy or consulate.

Hope this will clear ur doubt!

If you like to read the manuals they are here and they explain how the officer should look at your application. http://www.cic.gc.ca/manuals-guides/english/op/op02e.pdf

That said is it the right time for the two of you to get married?

Are you BOTH ready to take this step?

Is this a marriage for the right reasons or just to get you into Canada?

What is the Law in India is irrelevant. I doubt they allow same sex marriage in India but almost everyone here accepts that they are okay.

The issue will be your ages and the relationship. You know Indian culture and that Indian traditional marriages and how huge this type of event is in India.

Yes you can marry but proving your marriage was done for all the right reasons will be your responsibility.

Good Luck, you will need it.

your difference in age will not be a factor in your application. Good documentation and presentation of your application will be the biggest determination.

good luck
