Subject: Canadian Embassy forcing me to sign waiver !
  The facts people :

Castaway?s background:
Date of Birth : 1971
Marital Status : single
Citizenship Status : Foreign National
Family Citizenship Status : Father, sister and brother Canadian citizens.

CastAway?s time spent in Canada :

1) 1975 - 1980
(left at the age of 9 accompanying parents)

2) 1984 - 1991 - Dad became Canadian citizen in 1986
(I left Canada at the age of 19 accompanying parents)

3) 1998 (spent 4 months in Canada)

Problem : Is CastAway entitled to any claims whatsoever ? ( Canadian Embassy overseas is currently denying him travel visa to sister?s wedding in Canada on condition that he sign a waiver of right to appeal Residency Status Determination)

Thoughts ?

Let?s work the problem people!!!!

IS THS SUPPOSE TO BE A TRICK QUESTION?

You have not even visited Canada since 1998 and from your question have not been a permanent resident since 1980 even though you do not explain how you became a PR.

You are thinking of fighting CIC over your PR status instead of sattending your sisters wedding!

WHY IS THERE EVEN A NEED TO ASK THE QUESTION?
YOU´RE 35 YEARS OF AGE AND HAVE LIVED OUTSIDE OF CANADA ALL YOUR ADULT LIFE AND HAVE NEVER TRIED TO REGAIN YOUR PR STATUS BEFORE SO NOW YOU´RE WILLING TO MISS YOUR SISTERS WEDDING FOR SOMETHING YOU NEVER CARED ABOUT FOR THE LAST 26 YEARS.

WHAT PROBLEM GO TO THE WEDDING!

Mmmmm. Read the OP carefully Roy : I left Canada in 1991. Inquired about claim to citizenship in 1998, was stonewalled by Immigration Canada. Regardless of what you may think about me attending the wedding or not, am I entitled to any claim whatsoever ?

Lets stick to the facts Roy. Am I entitled to a claim of citizenship or PR status reactivation ? Is it true that I could claim PR status at any POE ? Thoughts ?

Under the old act a minor could not give up their PR ststus but you have to read section 190 of the act and in theory it is the same now BUT the residency requirements apply. If your father became a CDN and you chose not to that is your choice. Now if you know the OP manuals this leads me to believe this is a trick question. If you have a IMM 1000 and have a single entry US visitor visa drive into Canada and then try to fight for re-enstatment but it will take time and can you stop earning a living and afford me fees or someone like me to fight this case?

I swear to you Roy this is not a trick question. I have no idea what an IMM 1000 is nor do I know what the OP is. Nevertheless, let me say (for what its worth) that I think you are an absolute genius for cracking this nut Roy.

So, you?re saying that if I take a flight out of this craphole country I?m stuck in, arrive at a US - Canada border town (Say Buffalo) and cross into Canada...What ?

BTW, give me an estimate of your fees for this job Roy. ie(ie: paperwork, hearings for "PR Restoration" , etc)

Yes, I do have the IMM 1000 pink slip. How would one fight for re-enstatement ?
