Subject: WITHOUT ANY STATUS IN USA
Is there anyone in this forum who is without any status in USA and applied for Canadian permanent residency? I came in USA with my family and we overstayed here for the last 10 years. I finished my University here, now i want to apply for Canadian PR from USA. Is there anyone in this forum who has the same situation like me and applied for/thinking to apply for Canadian PR? Actually i want to know if it´s really possible for me to apply.

Mike

Speaking from my experience, they will ask you to prove that you are and have been in the US legally if you are not a US citizen. They were pretty anal about that in my case. I think you have a better chance of somehow getting status in the US than applying to Canada.

I was in a similar situation in the USA. I had to leave the country on voluntarty departure. I would suggest applying for "adjustment of status" in the USA. Unfortunately the judge in my case counted my illegal stay as 9 years and 11 months(sucker). But if you have been illegal for 10 or more years, you are legally supposed to be granted full citizenship. Check with an attorney.
The canadian application does ask you if you have overstayed any visa for any country..and you are gna say "YES", you ´may´ be denied, it would seem like bad intentions(even if you were young and didnt know). It is really important that you adjust your status soon and stay out of trouble! INS found out about my 10 year illegal stay, from the simple things such as traffic violations, fta, these will come up if your name is ran in the system for any given reason.
I have tried to apply to other countries for work visas, and was not approved, probably because of my overstay in the USA is now documented.
Perhaps trying to apply to Canada from your place of birth or nationality, but you would have to actually be present for interviews etc. good luck.

if you have stayed one year legal in US and are now illegal you can apply but for the interview you will have to return to your home country. Thats is a risk you will have to take. Plus the application time will be as of your home country.
