Subject: PLS Help - Divorce while application under process
  Dear All,

Especially the Experts -

WE appllied as family years back - now I am getting a Divorce - I am the Pincipal applicant - pls advice, what should I provide the CIC Office with only Divorce Certificate - do I need to provide CUSTODY Assignment - coz kids will stay with the mother - and do I need to write their names and details in my application forms coz I need to send updated forms - pls help me in this regard coz matter is very urgent I have only fews day before the deadline

if you ever want to sponsor them in the future, you children must be included in your documents.

Thanks SHARON, I was depending on you to give me a full detailed answer - thanks alot

one more thing, if I register their name in the application - do they need to undergo the medicals with me as well, and if I cant bring them to the medicals, coz they are with their mother in other country

I don´t know very much about this aspect of immigration so my answers would only be guesses. I only offered what I know for sure.

I hear various stories that the medicals are critical. would their mother not cooperate? The consequences appear to be significant if this cannot be accomplished.

Hopefully someone else can offer clarification.

unless they are examined at the time of your application, they will be inadmissible into Canada future (forever),meaning you cannot sponsor them or claim them to be your dependents.

Anonymous, what would this eaxmination be? Dream ignore this guy´s advice. Make sure you include them in the application but now that they will remain outside Canada with their mother, inform CIC of this fact and leave it at that. If you inform CIC that they are NOT accompanying you, they do not need to go throught the immigration medicals. If and when you sponsor them in future, they will go through medicals at that time.

According to the Immigration and Refugee Protection Act and Regulations, an officer can issue a permanent resident visa only if it has been established that the applicant and his family members, whether accompanying or not, are admissible on medical, criminal or security grounds. For this reason, they must be examined even if they are not accompanying you to Canada. The fact that a family member has undergone a medical examination does not mean that a visa will be issued for that person. No visa will be issued to a minor child without either the written authorization, duly notarized, of the parent who is not immigrating to Canada and who exercises parental authority over the child or the express authorization of a court of law.

Any current family member not examined in this application can NEVER be sponsored by you in the future. Misrepresenting or withholding information would render you inadmissible to Canada.

You are all helped in some way,

BUT for the kids I think they will never go to CANADA, so do I really need to put them in the Application Now,

I will submit my application forms next week, I think I am going to let Blanck and will send a letter to inform CIC Office about the current changes.
