I am looking for different options.
Are you saying that if she comes here with a visitor visa and later declares herself as refugee - she can apply for a PR status while in Canada.
I am not really clear on how this works.I always assumed that if a person applies for a refugee status they can?t apply for a PR in the same time and stay in Canada...

I have a question for the experts.
My sister who is in Latin America wants to come as a caregiver to Canada.I am sure that she will be approved, however she has a small child that she can?t leave behind.
Can she apply for a visitor visa for the child and come with her.Maybe she can renew it after for the period of 2 years.

Thanks

She can apply for a visitor visa for a child.
http://www.dfait-maeci.gc.ca/latin-america/chile/visa/stago03b-en.asp

The problem comes under "live in criteria" will the prospective employer allow the child to stay with the mother. Also would the immigration officer believe that the child will return?
http://www.cic.gc.ca/english/pub/caregiver/caregiver-2.html

The good thing is the child is eligible for PR status and doesnt need to go out of the country.Temporary residents "CANNOT" apply for permanent resident status from within Canada.
EXCEPTIONS:
-refugees or protected persons;
-live-in caregivers; and
-spouses or common-law partners of Canadian citizens or permanent residents

I forgot to mention the CIC would have to accept the refugee claim and giver her refugee status before she applies for PR card. This could take a while.

I think the better option would be to is get a work permit (caregiver) and then apply for PR.

To Nannie (in reply to: Caregiver (continue))
If you meet the 2 year work requirement under the program and applied for Permanent Residence + open work permit before March 15, 2009 then there is no need to extend your work permit (you already have the open work permit application)... you are considered on IMPLIED STATUS until such time there is a decision to your application for open work permit...

When did you apply... usually decision for open work permit will be decided 6-7 months after the application is submitted.

Good luck!
