  Long story but I will make it short. My husband applied for independent immigrant Dec. 2000 and we got married Dec 2001. He got his immigrant visa Jan 2002, i gave birth to my son march 2002 and May 2002 my husband went to canada wihout updating embassy in the Philippines about me and my son following an advise from a personnel ( who did the orientation) from CFO Commission on Filipino Overseas under DFA Department of Foreign Affair. He sponsored as July 2002 but was screwed by a consultant who actually filed it Oct 2002. We got denied, hired a consultant(again!) and filed an appeal. My son was given a visa in 2004 and Im not. My husband hired again a consultant and worked out for my immigrant visa but program manager in the Philippines want to cancel my son´s visa and told that both of us will be given immigrant visa ( through huminatarian reason) at the same time but my son should repeat his medical. My husband refused it ( he waited more than 3 yrs for that visa!) but instead request for my Temporary Resident. I was given a TRP but only for two years. I applied for work permit here in Canada and was approved.
Now, my husband want to REsponsor me. Do you think the Program Manager will still give me an immigrant visa. We knew that application for sponsorship will be refused and papers will be forwared in the Philippines for permanent resident visa application, . Or is there any chance that sponsorship will be approved in here though I am not considered as fasmily class as per subsection 117(9)d of the immigration rules.
I am thinking if Canadian Embassy in the Philippines will give me immigrant visa through huminatarian reason, why do they need to refused the sponsorship application. dont know.?

To clarify , my husband refused the program manager´s offer for immigrant visa for me and my son because he wants my husband to repeat the sponsorship process in Canada and when denied he will receieve my immigrant application and from there he will give me a visa as an immigrant. my husband is thinking it will take months to do this and he really is too tired of WAITING>

since he accepted the initial PR without updating his file (including you), he can´t sponsor you. the marriage took place before he got the PR.
the only option would be to divorce and marry you again. in this way you would have a marriage cert dated after he was granted PR.

are you working right now? I am afraid Mircea is right...have you considered applying as skilled worker while in-canada...I don´t really know if it´s even an option but try to ask around to know all your options...or better yet scout for a really good immigration consultant.

well, our latest immigration consultant is asking $4000 but he will basically just follow what the embassy program manager in philippines told us to do. so im thinking we can do it ourselves since it is just more on filling up forms and completing the requirements/ checklists.
joe, yeah im working right now at CIBA Vision through an agency. I cannot apply for skilled worker for i guess i will not meet the points requirements. I did not finish college or universities, only vocational courses only cosmetology and care giver course.

Question, If I have worked 2 years using my working visa, am I eligible to apply for an immigrant visa independently not to involve my husband.

Is your experience in the field of cosmetology? I found the National Occupational Classification # (NOC#) for you if you are in cosmetology area...

Mircea is right. If he applied, then married you and didn´t tell CIC and then got PR you canNOT be responsored. Ever. If he divorced you and then remarried you I don´t think that would work either because CIC would think that was strange and they wouldn´t let you so easily bypass their rules.

Best thing to do - check the link above to make sure you don´t meet the points.

If you don´t, all you can do is see if you can get an HRDC approved job i.e. prove that only you can do the job, no Canadian can do it. This is pretty hard, though.

Otherwise, start studying for a degree or other ways to improve your points as there aren´t any other ways in (not humanitarian - you´re not a refugee).
