Subject: Questions about marriage and PR.
  Hey guys, this is my first time posting here. I was hoping someone could point me in the right direction for my situation.

My best friend and I were playing an online game and she started talking to someone who is now her boyfriend. He in turn introduced me to his friend. We´ve been "seeing" each other for several months now and would like to get married and all four share a house together because of our tight finances. They could marry here from what I understand, but we can´t marry here (usa) because gay marriage isn´t permitted. I have read CIC´s website (cic.gc.ca) so many times, and I still don´t know how to handle our situation. If we married while visiting in canada, would we then be able to apply for a PR Card, so we can help with our bills?

if neither of you are Canadian, you must apply as skilled workers (one of you) and list the other as partner. If you can be married, your application would be easier. For sure, your common law marriage must be 1 year in duration with ample substantiation to that fact.

You still must qualify under the SW category and show funds for settlement etc. Approval could take 2 years.

I am assuming you are currently in the US and your friends are Canadian?

Correct, we are in usa and our partners are in canada. Sorry I wasn´t clear on that.

unfortunately i dont think either one of us qualify for SW. If we married while in canada, could they sponsor us for a year or until we could obtain PR status?

there are some steps that must be taken before you would be eligible to work in Canada.

first, they must start a spousal sponsorship. there is onus on the couple to prove the genuine status of the relationship. Once that occurs, your file gets moved to your home country for additional screening.

This is not my area of experience, however, I know for sure that this is not a quick process. Helping with the bills is a long way off.

is "onus" a typing error? I´m confused. Also what is the process of proving it´s a genuine relationship? I´m sorry about all the questions, and really appreciate your help.

you are going to have to prove to immigration Canada that your relationship is not for the purpose of gaining residency in Canada. CIC will assume it is. I am hearing some of our collegues have submitted applications hundreds of pages long.

Hi Alex, just to confirm you best friend, a girl, met a guy online and has started a relationship with this guy. Your best friend boyfriend has introduced you to his friend.
There are now two couples, your friend and her partner, and you and your partner.
Now, provided that both partners, are Canadian Citizens or have PR status in Canada you and your best friend can both be sponsored under the family class. Your best friend can marry her boyfriend in the US and he can apply for her as a spouse.
Alex,your options are: come to Canada where it is legal to have a same sex marriage and marry your partner and your partner would sponsor you as his spouse. Or, your partner can sponsor you as his conjugal partner. For conjugal partner application you will have to provide extensive proof that the relationship is genuinue and continuing.

The validity period for spousal visa and responsiblity is 3 years after the PR residency is establish. There is no one-year sponsorship limit.

If neither of the two gents in question hold Cdn residency status both you and your best friend would have to proceed as Sharon suggested and complete SW applications.

The only other problem is that while applying for PR, you won´t be able to work. So your partner would be the only one drawing an income.

Someone can correct me on that.
